Real Estate Sale Terms
Bidding Procedure: Property sells to the highest bidder(s) subject to confirmation of Seller.
Acceptance of Bid Prices: The successful bidder(s) will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding.
Down Payment: 10% of final bid price as down payment (earnest money) will be deposited with the Auction Company on the date of auction upon signing of Confirmation of Sale Agreement; balance due at closing. Bidding IS NOT CONDITIONAL UPON FINANCING.
Real Estate Taxes: Taxes will be prorated to date of closing using short proration method. Purchaser to be responsible for any CAUV recoupment due to change in land use (see Bidder Packet).
Closing Date: On or before April 6, 2007. Purchaser will pay customary portion of closing costs at closing.
Possession: Date of closing.
Survey: The Seller will provide a new survey to the Purchaser(s). All lot splits are zoned for agricultural use (i.e. single-family dwellings & agricultural uses allowed). All lot splits and terms of sale are contingent on approval by all county and township regulatory agencies.
Easement: Tract 1, Tract 2, and Tract 3 are subject to a 20’ wide easement for the installation and maintenance of tiling and drainage from Tract 4 to the drainage ditch located on Tract 1 and Tract 2 (see survey drawing).
Tiling: Per Miami County Health District requirements, seller will install drainage tiling prior to closing from Tract 4 through Tract 3 and Tract 2 to the drainage ditch located on Tract 1 and Tract 2. Future septic system on Tract 4 may be required to connect to this tiling based on Health District requirements at the time of building (see Bidder Package). Prospective buyers should contact Miami County Health District for more information on septic system installation guidelines.
