REAL ESTATE SALE TERMS
Bidding Procedure: The property will sell to the highest bidder subject to the confirmation of the Seller.
Acceptance of Bid Prices: The successful bidder will sign a Confirmation of Sale Agreement at the auction site immediately following the close of bidding.
Down Payment: $50,000 down payment will be deposited with the Auction Company on the date of auction upon signing of Confirmation of Sale Agreement; balance due at closing. Bidding IS NOT CONDITIONAL UPON FINANCING.
Real Estate Taxes: Taxes will be prorated to date of closing using long proration method.
Closing Date: On or before April 4, 2011. Purchaser will pay customary portion of closing costs at closing.
Possession: Date of closing subject to wheat harvest terms below.
Wheat Harvest: Tenant has planted and contracted the 2011 wheat crop for Summer 2011 delivery and will reserve the right to harvest the crop during the Summer of 2011. Purchaser will receive half of the net income from the crop within thirty days of the harvest date. Purchaser will receive full possession of this portion of the property immediately following the wheat harvest.
